Shoplifting Sentences
If the shoplifted item or items have a value of more than $2000.00 (or the aggregate value during a single criminal episode has a value or more than $2000.00) the Shoplifting Charge is a Class 5 Felony and sentences are as follow:
First Offense: Up To 2.5 Years Incarceration
Second Offense: 1-3.75 Years Prison
Third Offense:3-7.5 Years Prison
If the shoplifted item or items have a value less than $2000.00 (or the aggregate value during a single criminal episode has a value or more than $2000.00) the Shoplifting Charge is a Class 6 Felony and sentences are as follow:
First Offense: Up To 2 Years Incarceration
Second Offense: 9 Months to 2.75 Years Prison
Third Offense: 2.25 -5.75 Years Prison
If the shoplifted item or items have a value that ranges between $250 – $2,000 (or the aggregate value during a single criminal episode) the Shoplifting Charge is a Class 1 Misdemeanor and sentences are as follow:
- Up to 6 Months Incarceration
- Fines up to $2,500 (plus 84% surcharge of fine)
