Extortion ARS §13-1804

Extortion occurs when a person commits Theft by knowingly obtaining or seeking to obtain property or services by means of a threat. Threats may include causing physical injury by means of a deadly weapon or dangerous instrument, causing physical injury in some other manner, causing damage to property, engaging in other conduct constituting a criminal offense, accusing someone of a crime or bringing criminal charges against anyone, exposing a secret or asserted fact – whether true or false, or causing anyone to part with any property.

Possible Sentences For Extortion

If the Extortion occurs when somebody threatens to use or causes physical injury while using a deadly weapon or dangerous instrument then this is a class two felony. If the person actually used a deadly weapon in the victim’s presence, then they are facing a dangerous offense, which carries prison only sentences.

  • First Offense: Mandatory Minimum 7 – 21 Years Prison
  • Second Offense: 14-28 Years Prison
  • Third Offense: 21-35 Years Prison

If the accused threatens to use the deadly weapon and did not actually display the weapon sentences range:

  • First Offense: Up to 12.5 Years Prison
  • Second Offense: 4.5 Years to 23.25 Years Prison
  • Third Offense: 10.5 to 35 Years Prison

For all other situations, Extortion is charged as a class four felony.

  • First Offense: Up to 3.75 Years Prison
  • Second Offense: 2.5 Years to 7.5 Years Prison
  • Third Offense: 6 to 15 Years Prison
