Fraudulent Schemes occur when a person knowingly obtains any benefit by means of false or fraudulent pretenses, representations, promises or material omissions, and this is done pursuant to a scheme or artifice. It is not necessary that the victim actually relied on the fraud. This also includes a scheme or artifice to deprive a person of the intangible right of honest services.

Second Offense: up to 23.5 Years Prison
Third Offense: up to 35 Years Prison
